Terms & Conditions — TopperGyan LMS

Welcome to TopperGyan. These Terms & Conditions ("Terms") govern your access to and use of TopperGyan's website, mobile applications, learning management system (LMS), courses, tests, live classes, content, and other services (collectively, the "Platform"). By accessing or using the Platform you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Definitions

“User” means any person who registers on or uses the Platform. “Content” means courses, text, videos, images, tests, assessments, solutions, articles, and other materials provided on the Platform. “Company” / “TopperGyan” refers to the operators of the Platform.

2. Acceptance & Eligibility

You must be at least 13 years old to use the Platform. If you are under 18 (or applicable age of majority), you must use the Platform with parent or guardian consent. By creating an account you confirm that the information you provide is true, accurate and complete.

3. User Accounts & Responsibilities

• Account creation: You may be required to register with a mobile number, email address or other information. You are responsible for safeguarding your login credentials.
• Accurate information: Keep your account details up to date. You agree not to impersonate others or provide false information.
• Security: Notify us immediately at ttopergyan@gmail.com if you suspect unauthorized use of your account.
• Acceptable use: You will not misuse the Platform (including attempts to reverse-engineer, overload, interfere with, or otherwise harm the Platform or other users).

4. Services, Content & Intellectual Property

All Content available on the Platform is owned or licensed by TopperGyan and protected by copyright, trademark and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial educational purposes only.

You may not reproduce, modify, distribute, publicly display, create derivative works from, or otherwise exploit any Content without our prior written permission. If you upload or post materials to the Platform, you grant TopperGyan a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and distribute such materials for the purposes of operating, promoting and improving the Platform.

5. Payments, Pricing & Refund Policy

Course prices, taxes and payment methods are displayed on the Platform at the time of purchase. Payments are processed using third-party payment processors and are subject to the processor's terms and privacy practices.

• No general refunds: Purchases of online batches, subscriptions or services are generally non-refundable, unless otherwise specified on the product page or required by law.
• Change of batch: If you purchase a batch by mistake you may request a change to another batch of equal value within 10 days of purchase (subject to availability and TopperGyan approval).
• Physical goods: If physical goods (books) are damaged or lost in transit due to courier, TopperGyan will replace the item. Incorrect address or refusal of delivery by the recipient may make the order non-refundable.
• Promotions: Promotional discounts, coupons and offers are subject to specific terms; misuse may result in cancellation of the order or forfeiture of offers.

6. Cookies, Tracking & Analytics

We use cookies, device identifiers and analytics tools to provide, secure and improve the Platform, personalize content, and analyze usage. Most browsers accept cookies by default; you may disable cookies in your browser settings but some Platform features may not function correctly if cookies are blocked. 7. Data Protection & Privacy

We collect and process personal information in accordance with our Privacy Policy. By using the Platform you consent to such collection, processing, transfer and storage (including transfers to servers located in India). If you are a minor, your parent/guardian's consent is required.

8. Sharing & Service Providers

We engage trusted third-party service providers (e.g., hosting, payment gateways, analytics, OTP providers) to operate parts of the Platform. These providers may have access to personal data only to the extent necessary to perform their services and are contractually obligated to keep information confidential.

9. Public Forums & User Content

If you post or share content in public areas (discussion forums, comments, reviews), that content may be viewed by other users and will be treated as non-confidential. Do not post personal information that you do not want publicly available.

10. Communications & Marketing

By registering you agree we may contact you by email, SMS, push notifications, WhatsApp or phone for transactional, service and marketing purposes. You may opt out of promotional communications by updating preferences in your account or emailing ttopergyan@gmail.com.

11. Security

We implement reasonable physical, technical and organizational safeguards to protect information we process and store. However, no system can be 100% secure—please take steps to protect your account and devices (e.g., keep OTPs and passwords private). We are not responsible for losses arising from compromised accounts where the User fails to keep credentials secure.

12. Termination & Suspension

We may suspend or terminate your access at our discretion if you breach these Terms, engage in abusive behavior, or misuse the Platform. Upon termination, your right to use the Platform ceases; certain information may remain accessible or retained for legal or operational reasons.

13. Limitation of Liability & Indemnity

To the maximum extent permitted by law, TopperGyan and its officers, employees, agents and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages (including loss of profits, data, or goodwill) arising out of or related to your use of the Platform. Our total aggregate liability for direct damages will be limited to the amount you actually paid to TopperGyan in the 12 months preceding the claim.

You agree to indemnify, defend and hold harmless TopperGyan from any claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or your violation of applicable law.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or related to these Terms or the Platform will be subject to the exclusive jurisdiction of courts located in Bengaluru, India, unless otherwise required by applicable law.

15. Modifications to Terms

We may update these Terms from time to time. When changes are material we will notify you via the Platform or by email. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

16. Additional Policies & Third Parties

Third-party websites, plug-ins, or links may appear on the Platform. TopperGyan is not responsible for the privacy practices or content of third-party sites. Please review the terms and privacy policies of any third-party services you use.

17. Exclusive Service Features & Media Consent

By using certain Platform features you may permit TopperGyan to access your camera or microphone to enable live classes, recording or video calls. Where you provide testimonials, rankings, photos or videos, you grant TopperGyan a worldwide, non-exclusive, royalty-free license to use such materials for promotion and operation of the Platform.

18. Refunds & Grievances (Summary)

• All refund requests are handled per the platform Refund Policy. Generally, online batches and services are non-refundable except as explicitly stated.
